Le secteur immobilier est en premi\u00e8re ligne.<\/span><\/p>\n<hr \/>\n<p style=\"text-align: justify;\">En France, le b\u00e2timent est le secteur le plus \u00e9nergivore avec <strong>46 %<\/strong> des consommations d\u2019\u00e9nergie et <strong>23 %<\/strong> des \u00e9missions de gaz \u00e0 effet de serre. Les auteurs de la <a href=\"https:\/\/www.deepki.com\/fr\/glossaire\/loi-de-transition-energetique\/\" target=\"_blank\" rel=\"noopener noreferrer\">loi de transition \u00e9nerg\u00e9tique<\/a> l\u2019ont bien compris et c\u2019est pourquoi pr\u00e8s d\u2019un <strong>1\/5<\/strong> des articles concernent le b\u00e2timent.<\/p>\n<h2 style=\"text-align: justify;\">Focus sur les 4 principales mesures qui viennent impacter l\u2019immobilier tertiaire<\/h2>\n<h3 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=8DCBF7621FACBD1E87CB7CB5C0217C52.tpdila21v_2?cidTexte=LEGITEXT000006074075&amp;idArticle=LEGIARTI000031049267&amp;dateTexte=20160526&amp;categorieLien=id#LEGIARTI000031049267\" target=\"_blank\" rel=\"noopener noreferrer\">Article 7 : Lever les freins \u00e0 l\u2019isolation des b\u00e2timents en mati\u00e8re d\u2019urbanisme<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">L\u2019article 7 offre la possibilit\u00e9 de d\u00e9roger aux <strong>PLU<\/strong> (plans locaux d\u2019urbanisme), aux <strong>POS<\/strong> (Plan d\u2019occupation des sols) aux <strong>PAZ<\/strong> (Plan d\u2019am\u00e9nagement de zone) dans les limites fix\u00e9es par un d\u00e9cret et par d\u00e9cision motiv\u00e9e, afin d\u2019autoriser :<\/p>\n<ul>\n<li>la mise en \u0153uvre d\u2019une <strong>isolation en saillie<\/strong> des fa\u00e7ades des constructions existantes,<\/li>\n<li>la mise en \u0153uvre d\u2019une <strong>isolation par sur\u00e9l\u00e9vation<\/strong> des toitures des constructions existantes,<\/li>\n<li>la mise en \u0153uvre de <strong>dispositifs de protection contre le rayonnement solaire<\/strong> en saillie des fa\u00e7ades,<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Le projet de d\u00e9cret est actuellement <a href=\"http:\/\/www.developpement-durable.gouv.fr\/Module-de-suivi-de-la-loi-de.html\" target=\"_blank\" rel=\"noopener noreferrer\">en cours de consultation<\/a>.<\/p>\n<p style=\"text-align: justify;\"><b>L\u2019objectif<\/b> : faciliter l\u2019isolation massive des b\u00e2timents pour r\u00e9duire leurs besoins en chauffage et en climatisation.<\/p>\n<h3 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=8DCBF7621FACBD1E87CB7CB5C0217C52.tpdila21v_2?idArticle=LEGIARTI000031048289&amp;cidTexte=LEGITEXT000031047847&amp;dateTexte=20160526\" target=\"_blank\" rel=\"noopener noreferrer\">Article 8 : Valoriser les b\u00e2timents \u00e0 \u00e9nergie positive<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">L\u2019article 8 pr\u00e9voit que le <strong>plan local d\u2019urbanisme<\/strong> peut imposer aux constructions de couvrir une part de leur <strong>consommation d\u2019\u00e9nergie<\/strong> par la production d\u2019<strong>\u00e9nergie renouvelable<\/strong>. Par ailleurs, un bonus de constructibilit\u00e9 de 30 % peut \u00eatre autoris\u00e9 pour les constructions faisant preuve exemplarit\u00e9 <strong>\u00e9nerg\u00e9tique<\/strong>, environnementale ou \u00e9tant \u00e0 \u00e9nergie positive.<\/p>\n<p style=\"text-align: justify;\">Le projet de d\u00e9cret est <a href=\"http:\/\/www.consultations-publiques.developpement-durable.gouv.fr\/projet-de-decret-relatif-au-bonus-de-a1220.html\" target=\"_blank\" rel=\"noopener noreferrer\">consultable<\/a> sur le site gouvernement.<\/p>\n<p style=\"text-align: justify;\"><b>L\u2019objectif<\/b> : favoriser la promotion des EnR dans les b\u00e2timents neufs.<\/p>\n<h3 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=8DCBF7621FACBD1E87CB7CB5C0217C52.tpdila21v_2?idArticle=LEGIARTI000031048207&amp;cidTexte=LEGITEXT000031047847&amp;dateTexte=20160526\" target=\"_blank\" rel=\"noopener noreferrer\">Article 14 : Embarquer les travaux d\u2019am\u00e9lioration de la performance \u00e9nerg\u00e9tique en cas de travaux importants<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">L\u2019article 14 veut profiter d\u2019un premier investissement pour engager en m\u00eame temps des travaux d\u2019<strong>\u00e9conomie d\u2019\u00e9nergie<\/strong> lors de travaux importants (ravalements, r\u00e9fection de toiture et travaux d\u2019am\u00e9nagement pour rendre des pi\u00e8ces habitables). Les op\u00e9rations d\u2019am\u00e9lioration de l\u2019<a href=\"https:\/\/www.deepki.com\/fr\/glossaire\/efficacite-energetique\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>efficacit\u00e9 \u00e9nerg\u00e9tique<\/strong><\/a> lors de travaux affectant les parties communes, sont ainsi d\u00e9cid\u00e9es en assembl\u00e9e g\u00e9n\u00e9rale \u00e0 la majorit\u00e9 simple.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000032611310&amp;dateTexte=&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener noreferrer\">Le d\u00e9cret<\/a> a \u00e9t\u00e9 publi\u00e9 le 30 mai 2016. Cette obligation est <strong>prolong\u00e9e par p\u00e9riodes de 10 ans \u00e0 partir de 2020 jusqu\u2019en 2050<\/strong>. Le niveau de performance \u00e0 atteindre est renforc\u00e9 chaque d\u00e9cennie. Un projet attendu de longue date, avant m\u00eame la <a href=\"https:\/\/www.deepki.com\/fr\/glossaire\/loi-de-transition-energetique\/\" target=\"_blank\" rel=\"noopener noreferrer\">loi de Transition \u00c9nerg\u00e9tique<\/a> gr\u00e2ce aux travaux de Maurice GAUCHOT dans un rapport publi\u00e9 en 2011.<br \/>Le fameux <a href=\"https:\/\/www.deepki.com\/fr\/glossaire\/decret-tertiaire\/\" target=\"_blank\" rel=\"noopener noreferrer\">d\u00e9cret tertiaire<\/a> (ex-d\u00e9cret Gauchot) attend de voir le jour depuis plusieurs ann\u00e9es maintenant.
