Initi\u00e9 en 2010 par la loi Grenelle 2, ce d\u00e9cret a pour ambition d\u2019instaurer une obligation de performance \u00e9nerg\u00e9tique des b\u00e2timents tertiaires. Remis \u00e0 l\u2019ordre du jour en 2015 gr\u00e2ce \u00e0 la loi de Transition \u00c9nerg\u00e9tique, suspendu en 2017 \u00e0 peine 3 mois apr\u00e8s sa publication, l\u2019obligation de r\u00e9novation \u00e9nerg\u00e9tique des b\u00e2timents tertiaires devrait finalement refaire son apparition au sein d\u2019un nouveau v\u00e9hicule l\u00e9gislatif : la loi ELAN (Evolution du logement, de l\u2019am\u00e9nagement et du num\u00e9rique). D\u00e9cryptage du nouveau texte.<\/strong><\/span><\/p>\n<h2 style=\"text-align: left;\"><span style=\"color: #000000;\"><b>Un objectif de r\u00e9duction des consommations \u00e9nerg\u00e9tiques maintenu<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; color: #000000;\">L\u2019article 55 de la loi ELAN maintient l\u2019obligation de travaux en vue de <strong>r\u00e9duire consid\u00e9rablement les consommations \u00e9nerg\u00e9tiques<\/strong> de certains b\u00e2timents ou parties de b\u00e2timents \u00e0 usage tertiaire. L\u2019objectif de r\u00e9duction <strong>se d\u00e9compose en plusieurs marches interm\u00e9diaires<\/strong>, fix\u00e9es par rapport \u00e0 2010 :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Une r\u00e9duction de 40%<\/strong> en 2030 ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Une r\u00e9duction de 50%<\/strong> en 2040 ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Une r\u00e9duction de 60%<\/strong> en 2050.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: left;\"><span style=\"color: #000000;\"><strong>Des modulations possibles en fonction des typologies de b\u00e2timents<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; color: #000000;\">La r\u00e9daction de la loi ELAN ne permettant pas <strong>d\u2019adapter les exigences \u00e0 la typologie de chaque b\u00e2timent<\/strong>, certaines disposition d\u00e9rogatoires ont \u00e9t\u00e9 pr\u00e9vues en fonction :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Des contraintes<\/strong> techniques, architecturales et patrimoniales du b\u00e2timent ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>De l\u2019activit\u00e9<\/strong> exerc\u00e9e au sein du b\u00e2timent et de son volume ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Du co\u00fbt des actions<\/strong> par rapport aux avantages attendus en termes de consommation \u00e9nerg\u00e9tique.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: left;\"><span style=\"color: #000000;\"><b>Une collaboration attendue entre propri\u00e9taires et locataires mais des p\u00e9rim\u00e8tres d\u00e9finis<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; color: #000000;\">Les propri\u00e9taires et les locataires, \u00e9tant tous les deux soumis \u00e0 <strong>l\u2019obligation de r\u00e9duction des consommations \u00e9nerg\u00e9tiques<\/strong>, n\u2019auront d\u2019autre choix que de dialoguer afin de <strong>trouver un terrain d\u2019entente concernant la mise en \u0153uvre des \u00e9ventuels travaux \u00e0 r\u00e9aliser<\/strong>. N\u00e9anmoins, nouveaut\u00e9 du texte, il est pr\u00e9cis\u00e9 que <strong>chacun reste responsable sur le p\u00e9rim\u00e8tre \u201cqui le concerne\u201d<\/strong>. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><i><span style=\"font-weight: 400;\">\u00ab Les propri\u00e9taires des b\u00e2timents et le cas \u00e9ch\u00e9ant les preneurs \u00e0 bail (\u2026) d\u00e9finissent ensemble les actions destin\u00e9es \u00e0 la respecter et mettent en \u0153uvre les moyens correspondant chacun en ce qui les concerne. Ils assurent conjointement la transmission des consommations d\u2019\u00e9nergie de leurs b\u00e2timents ou parties de b\u00e2timents pour suivi du respect de leur obligation. \u00bb<\/span><\/i><\/span><\/p>\n<h2 style=\"text-align: left;\"><span style=\"color: #000000;\"><b>Un nouveau d\u00e9cret (tertiaire) attendu afin de donner plus de pr\u00e9cisions concernant l\u2019obligation<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; color: #000000;\">Enfin, un d\u00e9cret devrait <strong>venir compl\u00e9ter cette obligation<\/strong> afin de pr\u00e9ciser :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Les cat\u00e9gories<\/strong> de b\u00e2timents concern\u00e9s ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>La m\u00e9thodologie<\/strong> \u00e0 suivre afin de d\u00e9finir les objectifs \u00e0 r\u00e9aliser ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Les conditions<\/strong> d\u2019application des modulations ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>La mani\u00e8re<\/strong> dont les donn\u00e9es devront \u00eatre transmises par les oblig\u00e9s ;<\/span><\/li>\n<li><span style=\"font-weight: 400; color: #000000;\"><strong>Les modalit\u00e9s<\/strong> de suivi de l\u2019atteinte des objectifs.<\/span><\/li>\n<li>\u00a0<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><b>Il semblerait donc que, apr\u00e8s <a style=\"color: #000000;\" href=\"https:\/\/www.deepki.com\/fr\/blog\/saga-decret-tertiaire\/\" target=\"_blank\" rel=\"noopener noreferrer\">de nombreux rebondissements<\/a>, le d\u00e9cret tertiaire soit enfin pr\u00eat \u00e0 faire son grand come-back ! La loi ELAN \u00e9tant en cours d\u2019examen \u00e0 l\u2019Assembl\u00e9e Nationale et b\u00e9n\u00e9ficiant d\u2019une proc\u00e9dure acc\u00e9l\u00e9r\u00e9e, celle-ci devrait donc passer avant l\u2019\u00e9t\u00e9.
